1. Acceptance of Terms

Welcome to AllAre.io. By accessing or using our website, mobile applications, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

AllAre.io is an intermediary platform as defined under Section 2(1)(w) of the Information Technology Act, 2000, and operates in compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules, 2021").

2. Eligibility

To use AllAre.io, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable law

By using the Platform, you represent and warrant that you meet these requirements.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice.

4. User Content and Reviews

4.1 Posting Reviews

When posting reviews on AllAre.io, you agree that your content:

  • Is based on genuine, firsthand experience with the business
  • Is accurate, honest, and not misleading
  • Does not contain false statements or defamatory content
  • Does not include personal attacks, harassment, or hate speech
  • Does not contain spam, advertisements, or promotional content
  • Does not infringe on any third-party intellectual property rights
  • Does not contain confidential or private information of others
  • Complies with all applicable laws and regulations

4.2 Prohibited Content

You may not post content that:

  • Is fraudulent, fake, or incentivized (paid reviews without proper disclosure)
  • Contains threats, obscenity, or sexually explicit material
  • Promotes illegal activities
  • Impersonates another person or entity
  • Contains malware, viruses, or harmful code
  • Manipulates ratings through fake accounts or coordinated activity

4.3 Content Ownership and License

You retain ownership of content you post. However, by posting content, you grant AllAre.io a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Platform.

4.4 Content Removal

We reserve the right to remove any content that violates these Terms, our guidelines, or applicable laws, without prior notice. We are not obligated to store or maintain copies of removed content.

5. Business Profiles and Listings

5.1 Creation of Business Profiles

AllAre.io is a public customer review platform. Business profiles on our Platform may be created by AllAre.io or by users using publicly available information, including but not limited to business names, logos, website URLs, addresses, and contact details that the business has made publicly accessible on the internet or through public directories.

The creation of a business profile does not require the prior consent or authorization of the business. This practice is consistent with the standard operating model of public review platforms worldwide, including Google Reviews, Trustpilot, and MouthShut, and is lawful under applicable Indian laws.

Business profiles created on our Platform contain only publicly available, non-sensitive, non-personal information. No private, confidential, or sensitive personal data is collected or displayed without consent.

5.2 Claiming a Business Profile

Businesses may claim and manage their profiles on AllAre.io. By claiming a business profile, you represent that:

  • You are authorized to act on behalf of the business
  • The business information provided is accurate
  • You will respond to reviews professionally and constructively

Once claimed, business owners can update their business information, respond to customer reviews, and report inappropriate or false reviews.

5.3 Business Conduct

Businesses agree not to:

  • Post fake reviews for themselves or competitors
  • Offer incentives for positive reviews without proper disclosure
  • Harass or intimidate reviewers
  • Manipulate their ratings through fraudulent means
  • Misuse legal threats or takedown requests to suppress genuine customer reviews

5.4 Removal of Business Profiles

AllAre.io does not remove business profiles solely upon request by the listed business. Business profiles serve the public interest by providing a platform for consumers to share genuine experiences. This is in line with the right to information and consumer protection principles. However, we may remove or modify a business profile if it contains factually incorrect information upon verification, or if required by a valid court order or government directive.

6. Intellectual Property

6.1 Our Intellectual Property

AllAre.io and its content, features, and functionality (excluding user content) are owned by AllAre.io and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Trademarks

"AllAre.io" and our logo are trademarks of AllAre.io. You may not use our trademarks without prior written consent.

7. Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Use the Platform for any unauthorized or illegal purpose
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any part of the Platform
  • Use automated systems (bots, scrapers) to access the Platform without permission
  • Collect user information without consent
  • Engage in any activity that could harm AllAre.io or its users

8. Intermediary Status and Safe Harbour

8.1 Intermediary Platform

AllAre.io operates as an intermediary platform under Section 2(1)(w) of the Information Technology Act, 2000. We provide a platform for users to post reviews and share experiences. We do not initiate, select, or modify the content posted by users, except for actions taken in accordance with these Terms, applicable law, or government directives.

8.2 Safe Harbour Protection

As an intermediary, AllAre.io is entitled to the safe harbour protection under Section 79 of the Information Technology Act, 2000, subject to compliance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We are not liable for any third-party content hosted on the Platform, provided we observe due diligence and comply with applicable guidelines.

8.3 Due Diligence

In compliance with the IT Rules, 2021, AllAre.io:

  • Publishes its Terms of Service, Privacy Policy, and community guidelines for all users
  • Informs users about prohibited content and conduct
  • Provides a mechanism for users and affected parties to report violations
  • Takes action on reported content within the timeframes specified by law
  • Cooperates with lawful government orders and court directives
  • Has appointed a Grievance Officer (see Section 15)

9. Disclaimers

9.1 Platform Provided "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 User Content

We do not endorse, verify, or guarantee the accuracy of user-generated content. Reviews represent the opinions of individual users, not AllAre.io. We are not responsible for any decisions made based on reviews or ratings on our Platform.

9.3 Third-Party Services

We are not responsible for third-party websites, services, or content linked to or from our Platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLARE.IO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST TWELVE MONTHS, OR ₹8,000 (INDIAN RUPEES EIGHT THOUSAND), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless AllAre.io and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the Platform

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally within 30 days.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

12.3 Arbitration

Any disputes arising from these Terms or your use of the Platform that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Jaipur, Rajasthan, India. The arbitration shall be conducted in English.

13. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last Updated" date at the top of this page. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Content Takedown and Reporting

14.1 Reporting Unlawful Content

Any person may report content on the Platform that they believe violates applicable law or these Terms by contacting our Grievance Officer (see Section 15). Reports should include:

  • Identification of the content in question (URL or screenshot)
  • Explanation of why the content is believed to be unlawful or violating
  • Your contact information
  • A statement of good faith

14.2 Action on Reports

Upon receiving a valid report, AllAre.io will:

  • Acknowledge receipt within 24 hours
  • Review the reported content
  • Take appropriate action within 15 days of receipt, in accordance with the IT Rules, 2021
  • Communicate the action taken to the complainant

14.3 Government Orders

AllAre.io will comply with lawful orders received from any court of competent jurisdiction or authorized government authority to remove or disable access to specific content, in accordance with the Information Technology Act, 2000 and applicable rules.

15. Grievance Redressal Mechanism

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, AllAre.io has appointed a Grievance Officer.

The Grievance Officer shall:

  • Acknowledge complaints within 24 hours of receipt
  • Resolve complaints within 15 days from the date of receipt
  • Be available to receive and process complaints during business hours

If you have any grievance or complaint regarding content on the Platform, the conduct of any user, or any violation of these Terms, you may contact the Grievance Officer with the relevant details and supporting documents.

16. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
  • Entire Agreement: These Terms, along with our Privacy Policy and Copyright Policy, constitute the entire agreement between you and AllAre.io regarding the Platform.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
  • Language: These Terms have been drafted in English. In case of any conflict between the English version and any translated version, the English version shall prevail.
