1. Introduction

AllAre.io respects the intellectual property rights of others and expects users of our Platform to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement in accordance with the Indian Copyright Act, 1957, the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. Reporting Copyright Infringement

If you believe that content on AllAre.io infringes your copyright, please submit a written notice containing the following information:

  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  • Identification of the infringing material and information reasonably sufficient to locate it on our Platform (e.g., URL or screenshot).
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  • Your physical or electronic signature (or that of the person authorized to act on behalf of the copyright owner).
  • Any supporting documents or evidence of copyright ownership (e.g., registration certificate, original work proof).

3. Submitting a Copyright Infringement Notice

4. Processing of Copyright Infringement Notices

Upon receiving a valid copyright infringement notice, we will:

  • Acknowledge receipt of the complaint within 24 hours
  • Review the complaint for completeness and validity
  • Remove or disable access to the allegedly infringing content within 36 hours of receiving a valid complaint, in accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • Notify the user who posted the content of the takedown and the reason for it
  • Provide the user with information about filing a counter-notification
  • Resolve the matter within 15 days from the date of receipt of the complaint

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification containing:

  • Identification of the material that was removed and its location before removal.
  • A statement that you have a good faith belief the material was removed due to mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement consenting to the jurisdiction of courts in Jaipur, Rajasthan, India.
  • Any supporting documents or evidence establishing your right to use the content.
  • Your physical or electronic signature.

6. Processing Counter-Notifications

Upon receiving a valid counter-notification, we will:

  • Acknowledge receipt within 24 hours
  • Forward the counter-notification to the original complainant
  • Inform the original complainant that the removed content may be restored within 15 days unless the complainant provides evidence of a court order or legal proceedings restraining the user from using the allegedly infringing material
  • Restore the content if no such evidence is received within the specified period

7. Repeat Infringer Policy

AllAre.io maintains a policy of taking action against users who are repeat copyright infringers. We may, at our sole discretion:

  • Issue warnings to first-time infringers
  • Suspend accounts of users with multiple valid infringement claims
  • Permanently terminate accounts of repeat infringers
  • Refuse service to known repeat infringers

8. Misrepresentation Warning

Any person who knowingly makes false or misleading representations in a copyright infringement notice or counter-notification may be liable for damages under the Indian Copyright Act, 1957, the Information Technology Act, 2000, and the Indian Penal Code / Bharatiya Nyaya Sanhita, 2023, as applicable.

Please ensure that you are the copyright owner or authorized to act on their behalf before submitting a copyright infringement notice.

9. User-Generated Content

AllAre.io is an intermediary platform for user-generated reviews and content as defined under Section 2(1)(w) of the Information Technology Act, 2000. We do not initiate, select, or modify user-generated content before it is posted. We rely on copyright owners and affected parties to notify us of potential infringement through the process described in this policy.

As an intermediary, AllAre.io is entitled to safe harbour protection under Section 79 of the Information Technology Act, 2000, provided we comply with the due diligence requirements under the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

10. Good Faith Review Disputes

This Copyright Policy is intended for legitimate copyright infringement claims only. It shall not be misused to suppress genuine customer reviews, opinions, or criticism posted on the Platform.

Reviews and opinions are generally protected as free expression and do not constitute copyright infringement simply because they are negative or unfavorable to a business.

If we determine that a copyright infringement notice is being misused to remove legitimate reviews or silence consumer feedback, we reserve the right to:

  • Restore the removed content
  • Take appropriate action against the party who filed the false notice
  • Report the misuse to relevant authorities if warranted

11. Intellectual Property of AllAre.io

All content, design, logos, trademarks, and software associated with AllAre.io are the intellectual property of AllAre.io and are protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws. Unauthorized reproduction, distribution, or use of any AllAre.io intellectual property is strictly prohibited.

12. Governing Law

This Copyright Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
