Copyright Policy

1. Introduction

AllAre.io respects the intellectual property rights of others and expects users of our Platform to do the same. This Copyright Policy outlines our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

2. Reporting Copyright Infringement

If you believe that content on AllAre.io infringes your copyright, please submit a written notice containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  2. Identification of the infringing material and information reasonably sufficient to locate it on our Platform (e.g., URL or screenshot).
  3. Your contact information, including name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  6. Your physical or electronic signature (or that of the person authorized to act on behalf of the copyright owner).

3. Submitting a DMCA Notice

4. Processing of DMCA Notices

Upon receiving a valid DMCA notice, we will:

  1. Review the complaint for completeness and validity
  2. Remove or disable access to the allegedly infringing content
  3. Notify the user who posted the content of the takedown
  4. Provide the user with information about filing a counter-notification

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification containing:

  1. Identification of the material that was removed and its location before removal.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  3. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or the district where AllAre.io is located if you are outside the United States).
  4. A statement that you will accept service of process from the person who submitted the original DMCA notice.
  5. Your physical or electronic signature.

6. Processing Counter-Notifications

Upon receiving a valid counter-notification, we will:

  1. Forward the counter-notification to the original complainant
  2. Inform them that the removed content may be restored in 10-14 business days
  3. Restore the content unless the complainant notifies us of a court action seeking to restrain the user from the allegedly infringing activity

7. Repeat Infringer Policy

AllAre.io maintains a policy of terminating accounts of users who are repeat copyright infringers. We may, at our sole discretion:

  • Issue warnings to first-time infringers
  • Suspend accounts of users with multiple valid infringement claims
  • Permanently terminate accounts of repeat infringers
  • Refuse service to known repeat infringers

8. Misrepresentation Warning

Under the DMCA, any person who knowingly makes material misrepresentations in a notification of claimed infringement or counter-notification may be liable for damages, including costs and attorney fees.

Please ensure that you are the copyright owner or authorized to act on their behalf before submitting a DMCA notice.

9. User-Generated Content

AllAre.io is a platform for user-generated reviews and content. We do not pre-screen content before it is posted. We rely on copyright owners to notify us of potential infringement.

10. Good Faith Review Disputes

This Copyright Policy is intended for legitimate copyright infringement claims. It should not be used to suppress genuine reviews or criticism. Reviews and opinions are generally protected speech and do not constitute copyright infringement simply because they are negative or unfavorable.

If we determine that a DMCA notice is being misused to remove legitimate reviews, we may restore the content and take appropriate action against the abuser.
